WASHINGTON, D.C. — ACORE welcomes today’s announcement by the Senate of a bipartisan permitting reform deal, an essential step to speeding up the deployment of clean energy and transmission in the United States.

“American economic growth requires an energy permitting system built on predictable, durable, bipartisan principles that will outlast two- and four-year election cycles,” said ACORE President and CEO Ray Long. “Clean energy builders and financers have made it clear they intend to keep investing in clean energy. The bipartisan legislation released today represents momentum toward providing the policy certainty the market needs to unleash capital and build the energy infrastructure we need.”

The Bipartisan American Affordability and Jobs Act of 2026 includes important provisions that will improve the efficiency and accountability of the permitting process and spur the development and modernization of much needed transmission infrastructure, including: 

• Prevention of arbitrary cancellation of projects and redress to discriminatory treatment of certain resources.

• Greater permitting efficiencies and reasonable guardrails to reduce the risk of excessive litigation.

• Expansion of transmission to reduce consumers’ energy burdens and improve reliability, through the following:
  • Streamlined authority for the Federal Energy Regulatory Commission to use its backstop permitting capabilities.
  • Interregional and regional transmission planning, including a more efficient consolidated planning process.
  • Cost allocation for independent transmission developers.

• Streamlined permitting, and requirements for the evaluation and deployment of advanced transmission technologies to achieve near term efficiencies and cost saving.

• Implementation of technologies and practices to reduce interconnection queue delays to bring needed generation and storage on-line.

These provisions are consistent with recommendations ACORE made in 2025 in coordination with our members.
